Laser Hair Removal
 
The following are key components of the bill that was signed into law:

• Lasers must only be used to perform laser hair removal
• Specific training and testing requirements for technicians
• A non-physician performing a laser hair removal procedure shall not diagnose, treat or offer to treat
• Physicians and their laser facilities are exempt from licensing requirements
• Facilities not owned by physicians must contract with a consulting physician and develop a protocol
• Facilities must comply with health care advertising restrictions to prevent false advertising and are prohibited from advertising any medical benefits from laser hair removal
• A $5,000 fine and loss of license may be imposed on facilities that fail to comply with diagnosis and treatment rules
• Facilities are required to notify the department regarding their consulting relationship
• Upon request, records must be submitted to the Texas State Medial Board
• Complaint signage and a toll free number must be posted at all facilities
• All lasers must be registered with the department according to department rules

Tanning Beds
 
The legislation prohibits a minor under the age of 16½ from using a tanning device and requires that a parent or legal guardian accompany a child between the ages of 16½ and 18 and sign a parental consent form at the tanning facility. These regulations are among the most stringent in the country.
